How is a philosophical tradition created? What role does literary biography play in the formation of intellectual reception history? Through a detailed analysis of the lives and works of post-Avicennan philosophers, this monograph traces the intellectual history and development of the Avicennan tradition from the fifth/eleventh to the eighth/fourteenth century. OBJECTIVES: To compare the practices of local research ethics committees and the time they take to obtain ethical approval for a multi-centre study. DESIGN: A retrospective analysis of outcome of applications for a multi-centre study to local research ethics committees. SETTING: Thirty-six local research ethics committees covering 38 district health authorities in England. MAIN MEASURES: Response of chairmen and women, the time required to obtain approval, and questions asked in application forms. RESULTS: We received replies from all 36 chairmen contacted: (...) four (11%) granted their approval, and 32 (89%) required our proposal to be considered by their local research ethics committee. Three committees asked us to attend their meetings. The application was approved by all 36 local research ethics committees but the time to obtain ethical approval varied between six to 208 days. One third of the committees did not approve the project within three months, and three took longer than six months. There was considerable variation in the issues raised by local research ethics committees and none conformed exactly to the Royal College of Physicians' guidelines. CONCLUSION: Obtaining ethical approval for a multi-centre study is time-consuming. There is much diversity in the practice of local research ethics committees. Our data support the recommendation for a central or regional review body of multi-centre studies which will be acceptable to all local research ethics committees. (shrink)

Biobanking is a relatively new concept in Egypt. Building a good relationship with different stakeholders is essential for the social sustainability of biobanks. To establish this relationship, it is necessary to assess the attitude of different groups towards this concept. The objective of this work is to assess the knowledge, attitude, and opinions of Egyptian patients towards biobanking issues. We designed a structured survey to be administered to patients coming to the outpatient clinics in 3 university hospitals in Egypt. The (...) survey included questions estimating the level of knowledge about the term “Biobank”, together with questions about the attitudes and opinions about related issues. Two hundred and fifty-nine patients participated in the survey. Eighty-one percent of participants reported that they never heard about the term before. About 85% expressed that they would be willing to donate their samples for research and about 87% thought that sample donation did not contradict their religious beliefs. Fifty eight percent were willing to participate in a genetic research project, 27.8% supported sharing their sample with pharmaceutical companies, and 32.4% agreed to share their samples with institutions abroad. Although there is limited knowledge about biobanking among Egyptian patients, many had a positive attitude towards sample donation and didn’t show religious concerns against it. However, they showed concerns regarding participation in genetic research and with sharing their samples across borders or with pharmaceutical companies. ABSTRACTAdopting a temporally distant perspective on stressors reduces distress in adults. Here we investigate whether the extent to which individuals project themselves into the future influences distancing efficacy. We also examined modulating effects of age across adolescence and reactive aggression: factors associated with reduced future-thinking and poor emotion regulation. Participants read scenarios and rated negative affect when adopting a distant-future perspective, near-future perspective, or when reacting naturally. Self-report data revealed significant downregulation of negative affect during the distant-future condition, with a (...) similar though non-significant skin conductance pattern. Importantly, participants who projected further ahead showed the greatest distress reductions. Despite the potential value of graduate-level research ethics training, most Middle East countries, including Jordan, do not routinely offer formal research ethics training. In students enrolled in Jordanian master’s level graduate program in pharmacy, the current study assessed: 1- differences in pre- and post-enrollment exposure to research ethics core themes, 2- whether this exposure was through a formal course or in an informal setting, and 3- student attitudes towards research ethics education and the need for integrating a dedicated research ethics (...) course into pharmacy graduate programs. A 12-item on-line survey was developed by the authors and disseminated to a convenience sample of current and former master-level pharmacy students in Jordan. A total of 61 eligible respondents completed the survey. A minority of respondents (38%) acknowledged receiving research ethics training prior to enrollment into a postgraduate pharmacy program with nearly half (16%) describing this training as informal. In comparison, a larger percentage of the total respondents (56%) had received research ethics training during their postgraduate program enrollment, with nearly half of those (25%) indicating that this training was informal. A majority of respondents reported a strong need for integrating a formal research ethics course into postgraduate pharmacy curriculum (90%) to support their research training and thesis writing (89%). The proposed work describes an approach for segmentation of activated sludge flocs from the microscopic images for monitoring wastewater treatment. The morphological features of flocs and filaments are related to the state of an activated sludge wastewater treatment plant and must be monitored for proper functioning. Hence, image processing and analysis could be a time-saving monitoring tool. To address this challenge, we propose a novel framework involving a multiphase edge detection algorithm based on information theory. The proposed framework is evaluated (...) and scrutinized critically considering the artifacts found in the photographs tested. To evaluate the segmentations, gold approximation of estimated truth images is created. In addition, the performance was subjectively evaluated for its potential for segmenting activated sludge images. This paper examines the Bahāʾī philosophy with all its religious values and humanitarian practices to assess their relevance to the modern times. The rationale behind the choice of this subject was to find out whether the Bahāʾī philosophy could be yet another force and potential ideology to offer a solution to modern time challenges that are faced globally. Using a qualitative research design, the data was collected through a content analysis and close reading of Bahāʾī scriptures, tablets, letters and other (...) library sources. A close study of the Bahāʾī doctrines, values and faith revealed that the Bahāʾī philosophy extended the message of uniting the whole humanity by uniting all religions and sects, despite their apparent differences. All religions, according to the Bahāʾī faith, are manifestations of God and work towards an identical and universal divine plan to educate the human race. The social ethics of the Bahāʾīs emphasized upon the “oneness of humanity”, abolition of racial discrimination, class distinction, and religious prejudices, without any need of priesthood or rigid rituals of worshipping. If implemented and complied universally in principle, the Bahāʾī philosophy could be one of the potential ideologies to resolve the racial and religious conflicts. (shrink)

The research seeks to analyze Arabic translation of the speech of the Kingdom of Saudi Arabia; as a special type (...) of political communication to reveal the most prominent strategies that have formed it, and to identify the mechanisms that have been achieved; which has given the speech its uniqueness and efficacy, as each speech carries with it its strategies and mechanisms that lead to its success or failure. The study adopted the pragmatic approach imposed by the nature of this work. It came up with a set of results, the most prominent of which is that the solidarity strategy is the most effective in achieving the goals of the Kingdom’s speech, and thus this strategy was an introduction to other strategies, especially the persuasive and directive strategies. Early executive function skills reliably predict school readiness and future academic success. While children’s skills undergo rapid development during the transition to formal schooling, it remains unclear the extent to which schooling exerts a unique influence on the accelerated development of EF and academic skills during the early years of schooling. In the present study, a quasi-experimental technique known as the school cutoff design was used to examine whether same-aged children who made vs. missed the age cutoff for school entry (...) significantly differed on EF, reading, and math outcomes. Data from 166 pre-k, kindergarten, and first grade children from a longitudinal study of literacy development were analyzed. Children were assessed on EF, reading, and math skills in fall and spring. Results revealed unique effects of kindergarten, but not first grade, on growth in EF and reading over and above the effect of age. Schooling was unrelated to growth in math. Because kindergarten represents the first year of elementary school and children’s first exposure to a formal schooling environment, kindergarten schooling may be uniquely positioned to produce greater gains in academic and behavioral outcomes compared to other grades. In recent decades we have been given one of the most interesting concepts in Islamic intellectual history, `the scientific miracle of Qur’ān whereby the proponents have almost established the scientific theories in the Qur’ān. However, such ardent claims must not come to be without any inspiration and methodology. This article, firstly, tries to trace the inspiration of such concept and then describe the methodology. However, as exciting as this concept seems, the methodology brings forth a very negative approach to prove (...) the miracle of the Qur’ān, which is value free. That negative value free mentality which is related to the status of prophet of Islam will be exposed and it will detail how the status of prophet of Islam was abated so badly to prove the science from the Qur’ān. To counter this negative narrative and to reveal the true status of prophet of Islam, arguments will be presented from the Qur’ān and Ḥadīth which are incontrovertible. According to the World Health Organisation, three to five million individuals are infected by influenza, and around 250,000 to 500,000 people die of this infectious disease worldwide. Influenza epidemics pose a serious public health threat. Moreover, graver dangers are encountered with influenza subtypes against which there is little or no preexisting human immunity. Such subtypes of influenza have the potential to cause devastating epidemics. Thus, enhancing surveillance systems for the purpose of detecting influenza epidemics in an early stage can quicken (...) response times and save millions of lives. This paper presents three adapting intelligence models: support vector machine regression, artificial neural network using particle swarm optimisation, and our intelligent time series to predict influenza epidemics. The novelty of the current study is that it proposes a new intelligent model to predict influenza outbreaks. The INTS model combines clustering with a time series model to enhance the prediction of influenza outbreaks. The innovation of our proposed model integrates the results obtained from the existing weighted exponential smoothing model with centroids obtained from clustering. We developed a surveillance system for influenza epidemics using Google search queries. The current research is based on a weighted version of the Center for Disease Control and Prevention influenza-like illness activity level obtained from the Center for Disease Control and Prevention data, as well as query data obtained from the Goggle search engine in the USA. The influenza-like illness data was collected from January 4, 2009, to December 27, 2015, stretching across a total time span of 312 weeks. Google Correlate was used to select search queries related to influenza epidemics. In total, 100 search queries were obtained from Google Correlate, 10 of which were better and more relevant search queries selected in this study. The model was evaluated using online Google search queries collected from Google Correlate. Standard measure performance MSE, RMSE, and MAE were employed to estimate the results of the proposed model. The empirical results of the INTS model showed MSE = 0.003, RMSE = 0.036, and MAE = 0.0185, indicating that the errors of the proposed model are very limited. A comparative model of predicting results between the INTS model, alternative Google Flu Trend, and autoregression with Google search data is also presented. This study examines the influence of the COVID-19 crisis on academic expectations among international students from north-western China. According to past studies, academic expectations are multifaceted, making it critical to test the methods employed to assess this fundamental trait. The outbreak of COVID-19 has resulted in various significant changes in education, which have shifted from traditional to online or mixed formats. As a result, examining international students' academic expectations along with their interactions with adopted technologies is a topic that addresses (...) the current situation and issues. A mixed approach, comprising two different instruments, was followed to achieve this primary objective. While a survey with a questionnaire was undertaken with 551 international students, divided into two groups, ten students were interviewed during and after the lockdowns. The findings revealed that COVID-19 had a significant impact on the academic expectations of students as well as many elements such as training for employment, personal and social development, international student mobility, motivation, social pressure, and social interaction with the help of supporting technologies. In terms of gender, men outperformed women in motivation, social interaction, training for employment, and personal and social development factors. Similarly, as per the grade variable, the same higher trend was seen in postgraduates. Based on these findings, a set of recommendations was put forward. In the future, technology will be helpful in China's educational sector, such as online group collaboration, open education, managing student retention, and supervising teachers' recruitment. It relies upon thermodynamics and information theory and is, therefore, applicable to all kinds of systems, which makes it most suitable for cross-disciplinary investigations and innovation. Multimodal neuroimaging provides a rich source of data for identifying brain regions associated with disease progression and aging. However, present studies still typically analyze modalities separately or aggregate voxel-wise measurements and analyses to the structural level, thus reducing statistical power. As a central example, previous works have used two quantitative MRI parameters—R2* and quantitative susceptibility —to study changes in iron associated with aging in healthy and multiple sclerosis subjects, but failed to simultaneously account for both. In this article, we propose (...) a unified framework that combines information from multiple imaging modalities and regularizes estimates for increased interpretability, generalizability, and stability. Our work focuses on joint region detection problems where overlap between effect supports across modalities is encouraged but not strictly enforced. To achieve this, we combine L1, total variation, and L2 group lasso penalties. While the TV penalty encourages geometric regularization by controlling estimate variability and support boundary geometry, the group lasso penalty accounts for similarities in the support between imaging modalities. We address the computational difficulty in this regularization scheme with an alternating direction method of multipliers optimizer. In a neuroimaging application, we compare our method against independent sparse and joint sparse models using a dataset of R2* and QS maps derived from MRI scans of 113 healthy controls: our method produces clinically-interpretable regions where specific iron changes are associated with healthy aging. Together with results across multiple simulation studies, we conclude that our approach identifies regions that are more strongly associated with the variable of interest, more accurate, and more stable with respect to training data variability. This work makes progress toward a stable and interpretable multimodal imaging analysis framework for studying disease-related changes in brain structure and can be extended for classification and disease prediction tasks. BackgroundBurnout is a syndrome that results from stressors in the work environment that have not been successfully managed. The prevalence of burnout among schoolteachers was always controversial. COVID-19 pandemic added more stressors to teachers since they had to change their working styles in response to the pandemic lockdowns or curfews. In Saudi Arabia, the prevalence and determinants of burnout among school teachers were not measured by any other group during the COVID-19 pandemic stressors.MethodsA cross-sectional survey was conducted among 879 teachers (...) in the Jazan region, Saudi Arabia, using the Maslach Burnout Inventory, during April 2021. Multistage cluster random sampling was used.ResultsThe mean age of the participants was 41.4 years. Male teachers represented 52.6% of the participants while females represented 47.4%. Most teachers showed burnout symptoms. Consequences of burnout were observed, such as using psychotropic medications, absenteeism, lack of job satisfaction, and changing schools. Using the MBI scale, most teachers showed medium or high emotional exhaustion, low depersonalization, and low personal accomplishment.ConclusionMost teachers showed symptoms of burnout during the COVID-19 pandemic. Being an expert and ability to adapt to technology during the COVID-19 pandemic proved to effectively reduce burnout symptoms. Increasing incentives, early detection, and improving the work environment is recommended to diminish burnout consequences. (shrink)

The primary and secondary sources of Islamic law often assume a binary distinction between ijtihād and taqlīd, ignoring a third level of engagement with the sources, which was conceptualized by some jurists as forming a distinct category. In this article I discuss the evolution of the terms ijtihād, taqlīd, and ittibāʿ, using a conceptual-historical approach. I argue that the use of taqlīd to mean “precedent-following” did not emerge as a technical term until after the time of al-Shāfiʿī. The distinction between (...) precedent-following and verifiable-following did not appear in legal discourse until the time of Aḥmad b. Ḥanbal. I also demonstrate that there were three approaches to these terms in legal discourse after the time of Ibn Ḥanbal, with three groups of jurists defining them in ways that advanced their different visions of law-making. I conclude with a discussion of the debate over the meanings of these terms in the eighteenth and nineteenth centuries. (shrink)

The text of the tract De arcubus similibus was published for the first time by M. Curtze in 1887. However, after examining some more Latin manuscripts and the Arabic MS Oxford, Bodleian Library, Marsh 663 it appeared, that Curtze's edition was rather an adaptation. Also Curtze's suggestion that Jordanus Nemorarius was the author was very probably wrong. The author of the tract was the Egyptian mathematician Ahmed ibn Jusuf as appears from the Latin manuscripts, and its translator, very probably, (...) Gerard of Cremona. In the tract Ahmed tried to prove, that the assertion ‘similar arcs are also equal arcs’ was wrong . His starting points were the propositions Euclid III, 20 and 21. Consequently, the tract can be looked upon as a commentary on the third book of the Elements. (shrink)

Islamic Banking and Financial Crisis, edited by Habib Ahmed, Mehmet Asutay, and Rodney Wilson, definitely has merit. The book comes at a time when conventional financial institutions face stress and, in many instances, utter failure as a result of the 2008 global financial crisis. While the book is not designed primarily as a retrospective, it does offer an opportunity for reflection.

Osmanlı dönemi şairi Ahmed el-Behlûl, şairlik yönünün yanı sıra Akâid sahasında Durretu’l-‘Akâi’d, Fıkıh sahasında el-Mu‘ayyene ve el-‘Izziyye ve Arap Dili ve Edebiyatı sahasında el-Makâmetu’l-Vitriyye gibi eserleri telif ederek çeşitli sahalarla ilgilenmiş bir âlimdir. Behlûl, ed-Durru’l-Asfâ ve’z-Zebercedu’l-Musaffâ fî Medhi’l-Mustafâ ismiyle meşhur divânını tamamıyla Hz. Muhammed’i medhe tahsis etmiştir. Başta Libya olmak üzere Kuzey Afrika’da meşhur olan Divan, (...) Kâdî ‘İyâz’ın el-‘Iyâdiyye isimli manzumesine yazılmış bir tahmis olup Arap alfabesinin 29 harfinin her biriyle başlayıp beşlemelerin sonlarını da yine aynı harfle bitirdiği 29 kasideden oluşur. Peygamber’in doğumu, nesebi, güzel ahlakı ve şemâili, mucizeleri, şirkin onunla ortadan kalktığı, şefaati, peygamberler arasındaki üstünlüğü, yaşadığı kutsal mekânlar, O’na duyulan özlem, O’na, Ehli Beytine ve Ashabına salavât getirmenin önemi, O’nun günah ve hatadan kurtarıcı olması ve ümmeti olmanın ayrıcalığı konularına değinmiştir. 1942 yılında Hindistan’da dünyaya gelen merhum Saîd Ahmed el-Bâlenbûrî, çağımızın önemli bilginlerindendir. Uzun yıllar Diyobend medreselerinde fıkıh ve hadis müderrisliği yapmıştır. Bu medreselerde okutulmak üzere birtakım ders kitapları kaleme almıştır. Onun yazdığı ders kitaplarından birisi de Hanefi mezhebi usulüne dair telif ettiği Mebâdiü’l-Usûl adlı eserdir. Bu çalışmayla ilgili eser tanıtılarak eksik görülen yönlerinin ortaya çıkarılması amaçlanmıştır.

Crime fiction by women writers across the globe has in recent years begun to explore the position of women detectives within post-feminist cultural contexts, moving away from the explicit refusal of the heterosexual romance plot in earlier feminist ‘hard-boiled’ fiction. In this article, I analyse Hawa Jande Golakai's The Lazarus Effect (2011) and The Score (2015) as part of the tradition of crime fiction by women writers in South Africa. Joining local crime writers such as Angela Makholwa, Golakai not only (...) questions orthodox conceptions of gender and sexuality in traditional iterations of the crime novel, but also combines elements of chick-lit with the crime plot. Reading the archetypal quest structure of the two genres against the background of Sara Ahmed's cultural critique of happiness, I argue that Golakai inventively recasts the recent sub-genre of the chick-lit mystery from the perspective of an Afropolitan detective. Her detective tenaciously undercuts the future-directed happiness script that structures conventional chick-lit and detective novels with their respective focus on finding a fulfilling heterosexual, monogamous romantic relationship, and the resolution of the crime and restoration of order. In this way, the novels defy the frequently assumed apolitical nature of chick-lit texts and also allow us to reimagine the idea of Afropolitanism, outside of its dominant consumerist form, as a critical Afropolitanism that emerges from an openness to be affected by the unhappiness and suffering of others. Bu çalışmada Türkiye’de ḳırâât tedrisatında istifade edilen mesleklerden biri olan ʿAṭâʾullâh mesleğine ait tercihlerin mahiyeti, Muḥammed ʿÂrif el-Ḥıfẓî’nin Muġni’l-ḳurrâʾ fî şerḥi Muḫtâri’l-iḳrâʾ adlı eseri özelinde ve el-ʿaşru’s-suğrâ programının sınırları içerisinde ortaya konulmuştur. Osmanlı coğrafyasında teşekkül eden ve Anadolu’ya özgü olan ḳırâât meslekleri, ḳırâât tedrisatında günümüze kadar varlığını sürdüregelmiştir. Bu meslekler, taḥrîrât ekolü mesabesinde olmasına rağmen Anadolu toprakları dışında neredeyse bilinmeyen, tanınmayan ve kendisine ḳırâât eğitim-öğretiminde yer verilmeyen bir terminoloji olarak günümüze kadar gelmiştir. Mamafih, söz konusu mesleklerden biri olan ʿAṭâʾullâh mesleğinden (...) ḳırâât tedrisatında günümüze değin yararlanılmasına rağmen bununla ilgili yeteri düzeyde akademik çalışmanın yapılmadığı müşahede edilmiştir. Nitekim ʿAṭâʾullâh mesleğiyle alakalı iki çalışma tespit edilebilmiştir. Bunlardan biri doktora diğeri ise yüksek lisans tez araştırmalarıdır. Bunun dışında mesleklere genel olarak temas edilen ve “Kırâat Eğitiminin Dünü, Bugünü, Yarını ve Kırâat Eğitiminde Meslekler” adıyla kitap bölümü olarak basılan bir çalışma ve mesleklere bir bölüm ayrılan Kıraat İlmi Eğitim ve Öğretim Metotları adlı araştırmalar da mevcuttur. Bahsedilen bu ilmi faaliyetlerden Ahmed er-Rüşdî ve Mürşidü’t-Talebe Adlı Eserinin Kıraat İlmindeki Yeri adlı eser dışında, meslek tercihlerinin mahiyetinin ortaya konduğu bir çalışmaya rastlanmamıştır. Ancak söz konusu çalışma, ekseriyetle Ataullah mesleğinin el-ʿaşru’l-kubrâ öğretiminde temel kaynak olarak kabul edilen Murşidu’ṭ-Ṭalebe’ye, bu eserin münderecatındaki vecîh ve tercihlerin tahliline yönelik olarak ele alınmıştır. Dolayısıyla açıklamaya çalıştığımız mevcut boşluğu doldurması beklenen bu çalışmada ise aşere/el-ʿaşru’s-suğrâ öğretiminde ʿAṭâʾullâh mesleği için temel kaynak olarak kabul edilen Muġni’l-ḳurrâʾda geçen vecîhler ele alınmış ve bunlara ait tercihlerin mahiyeti, uṣûl ve ferşu’l-ḥurûfla alakalı örnekler eşliğinde ortaya konulmuştur. Bu bağlamda çalışmanın temel amacı, ʿAṭâʾullâh mesleğiyle ilgili tercihlerin arka planının Muḥammed ʿÂrif el-Ḥıfẓî’nin Muġni’l-ḳurrâʾ fî şerḥi Muḫtâri’l-iḳrâʾ adlı eseri özelinde izah edilmesidir. Nitekim mezkûr mesleğe ait tercihlerin keyfiyeti, el-ʿaşru’ṣ-ṣuġrâ müfredatının temel kaynakları olan et-Teysîr fi’l-ḳırââti’s-sebʿ ile Ḥirzu’l-emânî ve vechu’t-tehânî fi’l-ḳırââti’s-sebʿ adlı eserler ışığı altında açıklığa kavuşturulmaya çalışılmıştır. Bu eserlere ek olarak ḳırâât alan yazınının temel eserlerinden de istifade yoluna gidilerek ʿAṭâʾullâh mesleğine ait tercihlerin ilgili eserlerdeki yeri ve bu tercihlerin sebepleri izah edilmiştir. Bu bağlamda Muġni’l-Ḳurrâʾ özelinde verilen örneklerin hepsinde mervî vecîhlerin tamamının ʿAṭâʾullâh mesleğinde tercih edildiği tespit edilmiş; fakat bunlardan -son örnek hariç olmak üzere- Şâṭıbî’nin kendi usulüne muhalefet ettiği ifade edilen vecîhlerin ise son örnek dışında muaḫḫar vecîh olarak zikredildiği görülmüştür. Ne var ki çalışmada yer verilen son örnekte ise ṭarîḳ muhalefeti söz konusu olmasına rağmen muḫâṭab vechinin ġāib vechine muḳaddem olarak tercih edildiği müşahede edilmiştir. Bununla birlikte ilgili örneklerde Îtilâf, Mutḳin ve Ṣûfî meslekleri tarafından icra edilen vecîhlerin genellikle birbirine mutabık olduğu ve onların bu vecîhlerde ʿAṭâʾullâh mesleğinden ayrıştıkları belirlenmiştir. Câhiliye döneminde şair ve hatipler tarafından bir meleke olarak kullanılan belagat, geçirdiği hazırlık ve gelişim döneminin ardından ilmî teşekkülünü tamamlayarak Arap dil ilimlerinde müstakil bir dal haline gelmiştir. Ebû Ya‘kûb es-Sekkâkî (öl. 626/1229) öncülüğünde “meânî-beyân-bedî‘” olarak üç başlık altında ele alınmaya başlanan belagat konularının bedî‘ kısmına, Sekkâkî sonrası şerh ve hâşiye dönemi müellifleri tarafından yeni sanatlar eklenmiştir. Bu sanatlardan birisi de tarif ve tesmiyesi Sa‘duddîn et-Teftâzânî’ye (öl. 792/1390) ait olan tecâzüb sanatıdır. Farklı pek çok disiplinde ilmî ve edebî bir terim (...) olarak yer alan bu sanatın etkin kullanım alanlarından birisi de fıkıh ilmidir. Fıkıh sahasında bu sanattan istifade eden âlimlerden birisi Şemsuddîn Muhammed el-Kuhistânî’dir (öl. 962/1555). Kuhistânî Câmi‘u’r-rumûz adlı eserinde öşrün vücûbiyeti ve şart muhayyerliği konularını izah etmek üzere tecâzüb sanatına başvurmaktadır. Ne var ki Kuhistânî’nin kullandığı tecâzüb ifadesi ilim dünyasında anlaşılamayıp muğlak ifadeler olarak kalınca bu ifadelerden kastın ne olduğunu açıklayan bazı risâleler kaleme alınmıştır. Bunlardan birisi de ‘Abdulganî en-Nâblusî’nin çalışmamıza esas olan en-Nesîmu’r-rebî‘î fi’t-tecâzübi’l-bedî‘î adlı risâlesidir. Nâblusî’nin bu risâleyi kaleme almasının ana nedeni, kendisinden önce Kuhistânî’ye ait ifadeleri açıklamak gayesiyle Esne’l-metâlib fî beyâni ma‘ne’t-tecâzüb adında muhtasar bir risâle kaleme alan Seyyid Ahmed el-Hamevî’ye (öl. 1098/1687) reddiye yapmaktır. Nâblusî, Hamevî’ye ait bu risâleyi görmüş ve onun tespitlerinden bazılarını hatalı bulduğunu belirterek reddiye mahiyetinde mezkûr risâlesini kaleme almıştır. Hamevî’nin açıklamalarına ciddi eleştiriler getiren Nâblusî, öşrün vücûbiyeti ve şart muhayyerliği hususlarındaki Kuhistânî’ye ait ifadeleri tecâzüb sanatı açısından yeniden açıklama yoluna gitmiş ve bu konularda Hamevî’ye ait toplamda altı görüşe deliller getirmek suretiyle reddiye yapmıştır. Nâblusî’nin bu risâlesi; zengin kaynak kullanımı, yalın ifade üslûbu ve açıklayıcı örneklerle öne çıkmakta, tecâzüb sanatına dair kapsamlı bilgiler ihtiva etmektedir. Bu araştırma ile ilk olarak tecâzüb kavramı Teftâzânî üzerinden açıklanmış; ardından Nâblusî’nin mezkûr risâlesi, reddiye yaptığı Hamevî’ye ait risâleyle mukabele edilmek suretiyle detaylı olarak analiz edilmiştir. Bu noktada ilk olarak tartışmaya esas olan Kuhistânî’ye ait ifade verilmiş, ardından Hamevî’nin konuya dair açıklaması zikredilmiş, son olarak da Nâblusî’nin reddiyesine yer verilmiştir. Şâfiî müctehidlerin muteber şahsiyetlerinden biri olan Râfiî el-Kazvînî, ilk olarak babası Muhammed b. Abdilkerîm el-Kazvînî (ö. 580/1184) ve annesinin dayısı Ebü’l-Hayr Ahmed et-Tâlkânî’nin (ö. 589/1193) rahle-i tedrisinde bulunduktan sonra alanında uzman birçok kişiden tefsir, hadis ve fıkıh sahasına ilişkin seviyeli bir eğitim almıştır. Yaşadığı asrın ileri gelen ulemasından İslâmî ilimleri okuyarak fıkıh ilminde ihtisas sahibi olan Râfiî, Kazvîn’de ders halkaları oluşturarak tedris faaliyetinde bulunmuş; dönemin halifeleri tarafından Şam ve Mısır baş kadılık görevine atanan Ahmed b. Halîl el-Mühellebî (ö. (...) 638/1240), Zekiyyüddin el-Münzirî (656/1258) ve İbn Sükkerî (ö.713/1313) gibi önemli simalar yetiştirmiştir. Zekâsı, aklı ve özellikle haiz olduğu fıkhî meseleleri ayırt etme yetisiyle Râfiî, doktrin içerisinde yer alan dağınık görüşleri toplayarak ilgili görüşlerden hangisinin daha kuvvetli olabileceğine dair tespitlerde bulunup mezhebi tahrîr/tenkîh etmiş, bir bakıma mezhebin görüşlerini ilmî elekten geçirip ayıklamıştır. Mezhep içerisindeki görüşleri inceleyerek farklı tarikleri birleştirme ve dağınık bilgileri ayıklayıp mezhep birikimini veciz ifadelerle yansıtma faaliyetinden dolayı ulemanın dikkatini üzerine çeken Râfiî, mezhepte iki otoriteden biri anlamına gelen Şeyhân’dan biri olma -diğeri ise Nevevî (ö. 676/1277)- unvanına layık görülmüştür. Bu yüzden onun hayatına ve ilmî kişiliğine Şâfiî terâcim eserlerinde oldukça yer verilmiştir. Bu çalışmada, sonraki dönemlerde mezhep görüşünü temsilde belirleyici olan Râfiî’nin ilmî kişiliği yanında mezhebi tahrîr/tenkîh etmesindeki rolüne yer verilecektir. (shrink)

Makalede, Osmanlı bilgini Şemseddin Ahmed b. Musâ el-Ḫayâlî’nin düşüncesi bağlamında değerin imkânı ve fiillere değer yüklemenin kaynağı sorununun incelenmesi amaçlanmıştır. Mu‘tezile ve Eş‘arîler karşısında Hanefî-Mâtürîdî gelenekte değer konusuna yaklaşımın ne olduğu sorusu Hayâlî’nin görüşlerine referansla ele alınmıştır. Hayâlî, kendi düşüncesini, hocası Hızır Bey’in el-Ḳaṣîdetü’n-nûniyye adlı kasidesine yazdığı şerhte ortaya koymuştur. Özellikle bu kasidenin “iyilik ve kötülük şer‘îdir ama/ biz bunların akılla bilinebileceğini söylüyoruz” dizelerinin yorumunda hüsun ve kubuh meselesini incelemiştir. Onun düşüncelerinin analiz edilmesi ve yorumlanmasında Muhammed Ömer b. eş-Şeyh (...) Abdi’l-Celîl b. eş-Şeyh Abdi’l-Cemîl el-Bağdâdî el-Hanefî’nin Ḥavâşî’l-Futûḥiyye li-Şerḥi’n-Nûniyye ve Mehmet Emin Üsküdârî’nin Ḥâşiye ʿalâ Şerḥi Hayâlî ‘ale’l-Ḳaṣîdeti’n-nûniyye adlı eserinden yararlanılmıştır. Eş‘arîler, insan için değer bilgisinin mümkün olmadığını iddia ederek, iyi ve kötü hakkındaki bilgimizin kaynağının din olduğunu kabul etmişlerdir. Mu‘tezilî düşünürler ise iyi ve kötüyü fiillerin zatına ya da fiillerin zatında bulunan sıfatlarla ilişkilendirmişlerdir. Cübbâîler gibi bazı Mu‘tezilî düşünürler, fiillerin yapıldığı bağlamın ve şartların da değer atfetmede önemli olduğunu ifade etmişlerdir. Değer konusunda, Buharalı Hanefî âlimler Eş‘arî değer anlayışına yakın dururken, Mâtürîdîler Mu‘tezilî fikirlere yakın durmuşlardır. Mâtürîdîler, dinin iyi ve kötü hakkında bilgi verdiğini kabul etmekle birlikte bazı şeylerin değerinin akılla bilinebileceğini iddia etmişlerdir. Çalışmamızda, Hayâlî’nin temel yaklaşımının Mâtürîdîlerin değer anlayışından yana olduğu gösterilmiştir. Fiillere yüklenen iyi ve kötünün anlamları konusunda Mu‘tezile ve Mâtürîdîler arasındaki benzerliklere dikkat çekilmiştir. İyi ve kötünün üç anlamının olduğu açıklanmıştır. İlk olarak iyilik, bir insanın fiilinin bu dünyada övülmesi ve ahirette ödüllendirilmesi anlamına gelir. Kötülük, bu dünyada yerilmeyi ve ahirette cezalandırılmayı ifade eder. İkinci olarak, iyi, amaca uygun olandır ve kötü ise amaca uygun olmayandır. Bu, aynı zamanda, iyinin yararlı olan ve kötünün de zararlı olan olduğu anlamına gelmektedir. Üçüncü olarak iyi, bir yetkinlik sıfatıdır ve kötü de bir eksiklik sıfatıdır. Örneğin bilgi, insanı yetkinleştirdiği için iyidir. Bilgisizlik, insanı eksik ve düşük bir durumda bıraktığı için kötüdür. Mu‘tezile’ye göre her şeyin iyilik ve kötülüğü akılla bilinirken, Mâtürîdîlere göre bazı şeylerin iyilik ve kötülüğü akılla idrak edilebilir. Bu bağlamda Mu‘tezilî ve Mâtürîdî düşünürler, sorumluluğu gerektiren değer bilgisinin kaynağının din olduğunu kabul eden Eş‘arîlerin argümanlarını eleştirmişlerdir. Makalede, ayrıca, tek bir cümlede doğruluk ve yanlışlığın birleşmesiyle ortaya çıkan yalancı paradoksu ile değerin kaynağı arasında kurulan ilişki ele alınmıştır. Yalancı paradoksunun bir çözümünün olduğuna inanan Hayâlî, bu çözüm üzerinden, Mâtürîdî değer anlayışının haklı gösterilebileceğini ifade etmiştir. (shrink)
